Supreme Court Verdict in Bilkhiz Banu Case
  • During the 2002 Gujarat riots, Bilgis Bhanu, who was 5 months pregnant, was gang-raped. 14 members of his family, including a 3-year-old child, were killed. 11 accused in this case were sentenced to life imprisonment.
  • The convicts sentenced to life imprisonment were released by the Gujarat BJP government on August 15, 2022. Bilkeez Banu approached the Supreme Court challenging the early release of the convicts. Many also filed public interest litigations seeking annulment of their release.
  • In the affidavit filed by the Gujarat government, it has been stated that 'the behavior of 11 convicts is good and they have been released on the basis of good behaviour'. The Supreme Court deferred judgment on various petitions filed against the release of the convicts.
  • In this context, the Supreme Court today gave its verdict on the petitions filed against the Gujarat government's decision to grant early release to 11 prisoners who were serving life sentences for the gang rape of Bilgis Bhanu and the crimes committed during the 2002 riots.
  • In the Bilkees Banu case, though the crime was committed in a state, the case was tried in Maharashtra. Therefore, while releasing the convicts before the term of their sentence, the concerned state should consult the state where the case has taken place.
  • The Gujarat government has no power to grant relief in the case of Bilgis Banu convicts. Victims' rights are very important, women's respect is important, women are respected. The decision of the Gujarat government to acquit the convicts in the Bilkees Banu case is annulled', the Supreme Court said in its verdict. The Supreme Court also ordered that the released convicts should surrender before the jail authorities within two weeks.
