- A single judge of the Madras High Court had already ruled that income tax cannot be imposed on the salaries of nuns and priests working in aided schools run by the Christian Church. "Since the salary goes directly to the district, TDS cannot be deducted," he had said in the judgment.
- The Income Tax Department appealed to the High Court against the decision of the Single Judge. In 2019, the 2-judge panel that heard the case ruled that the salaries of nuns and priests are subject to income tax deduction.
- Appeals were filed in the Supreme Court by the church school administrations against this. The case came up for hearing in the Supreme Court Chief Justice DY Chandrachud, JP Pardiwala and Manoj Mishra session.
- At that time, senior lawyer Arvind Thattar, who appeared on behalf of the petitioners, said, "The subsidy given by the government as a salary goes directly to the district, but not to the nuns and priests who work in the schools. Therefore, they should be exempted from deducting TDS from their salaries,” he argued.
- However, the judges refused to accept this. They said in their order: If a person receives salary, income tax must be deducted on it. Exemption from deducting TDS cannot be claimed.
- Law is common to all. Government will not give grant amount Government will never give grant amount to hidden district. The amount is given only to persons working as teachers in schools. That salary is also paid into the bank account of the nuns and priests. It should be considered as their income.
- Therefore, we also confirm the Madras High Court's order that the salaries paid to nuns and priests working as teachers in church-run aided schools are also subject to income tax. The judges, who said this, dismissed the appeals filed by the church school administrations.
