Supreme Court orders cancellation of order to dissolve 16,000 madrasas in UP
- The Uttar Pradesh Board of Madrasa Education Act, 2004 was introduced by the then Mulayam Singh Yadav-led Samajwadi Party government. However, earlier this year the Allahabad High Court declared the Madrasa Act unconstitutional while hearing a writ petition.
- After hearing its appeals, the Allahabad High Court's order to decriminalize madrasas has been quashed. A three-judge bench headed by Chief Justice of India TY Chandrachud overturned the Allahabad High Court verdict, declaring the law unconstitutional and violative of the principle of secularism.
- The High Court urged the state government to dissolve madrassas and accommodate the students studying there in formal school system. This has put the future of around 17 lakh madrasa students in question. In the case against the order, the Supreme Court said that there was a mistake in the Allahabad High Court judgment.
- According to the Supreme Court judgment released today, the government does not have the right to acquire all the properties belonging to the people for public benefit. Supreme Court Chief Justice T.Y. In a 9-judge bench headed by Chandrachud, 7 judges gave a unanimous verdict.
- The judgment held that states cannot acquire property belonging to citizens in the community in the public interest as per Article 39B. Justice T.Y. held that the property owned by an individual cannot be considered as common to all in the society, as the property serves their needs. Chandrachud mentioned in the judgment.
- The Central Government has released the 15th Finance Commission grants for the financial year 2024-25 to rural local bodies in the states of Haryana, Tripura and Mizoram. Unconditional grants worth Rs 194.867 crore have been given as part of the first tranche to rural local bodies, Panchayat Raj bodies of Haryana.
- Funds have been provided to 18 eligible district panchayats, 139 eligible district panchayats and 5911 eligible gram panchayats in the state who have fulfilled the criteria for release of funds.
- Rs 31.40 crore as first installment of unconditional grant and Rs 47.10 crore as first installment of defined grant have been released to rural local bodies in Tripura. This fund is provided to all 1260 rural local bodies.
- Finance Commission has also provided funds to Mizoram. This is the 2nd tranche of unconditional grants for FY 2022-23 comprising Rs 14.20 crore and the 2nd tranche of 2022-23 defined grants of Rs 21.30 crore. This fund will be shared among all the 834 village councils including the autonomous district council areas.
