Supreme Court restrains enforcement department's arrest in illegal money transfer case

  • The Supreme Court had ordered that the enforcement department cannot arrest a person accused under the Prevention of Money Laundering Act in a particular case after the registration of charges in a special court. 
  • The appeal filed in this regard came up for hearing before a bench comprising Justices Abhay S. Oka and Ujjal Bhuyan. At that time, the Supreme Court imposed restrictions on the enforcement department's arrest in the illegal money transfer case.
  • PMLA Under section 19 the enforcement department can arrest a person on suspicion; In a case where a charge sheet is filed, the enforcement department has to obtain permission from the court to make an arrest. No one shall be arrested without the special permission of the court after the charge sheet has been filed. 
  • ED has to file a petition in the concerned court to take the accused into custody. A special court will examine the grounds for detention and decide on the enforcement petition. Should the accused be sent to ED custody? Don't you? The Supreme Court also said that the special court will decide.
