Supreme Court's Constitution bench ruling that the Government is more powerful than the Governor of Delhi
  • Law and order in the Union Territory of Delhi is under the control of the Union Home Ministry. Delhi is currently ruled by the Aam Aadmi Party led by Chief Minister Arvind Kejriwal. There were frequent conflicts between the government and the Lieutenant Governor of Delhi regarding the administration of the state.
  • In this regard, the Aam Aadmi Party filed a case in the Delhi High Court in 2015. The High Court heard this and in 2016 ruled in favor of the Governor. Against this verdict, the AAP government appealed to the Supreme Court.
  • In 2019, a two-judge bench gave a different verdict in the case. One judge ruled in favor of the government and another in favor of the lieutenant governor. Subsequently, the case was transferred to a 3-judge bench. The case was transferred to the Constitutional Bench of the Supreme Court in July last year on the request of the Central Government.
  • According to this, a bench of Chief Justice Chandra Chute, Justices MR Shah, Krishna Murari, Hima Goli and Narasimha heard the case.
  • Meanwhile, the "National Capital Territory of Delhi Government Amendment Act" was passed in Parliament in 2021. According to the new law, it is mandatory for the Delhi government to consult the Lt. Governor in any decision. After this, even the transfer of government officials required the approval of the Lt. Governor.
  • In this context, the Constitutional Bench headed by Chief Justice Chandrachud of the Supreme Court gave its verdict yesterday. It said: There is a difference between Delhi and other Union Territories. Delhi may not have statehood. But, there is legislative power. In a democracy, only the government elected by the people should have power.
  • Apart from matters like public order, police and land, all other powers rest with the elected Delhi government. IAS officers are bound by their respective Ministers.
  • Rather than the Lt. Governor of Delhi, the people's elected government has full power. The Lieutenant Governor should act as per the instructions of the Delhi Government. Thus the Constitutional Court has ruled.
