பட்டியல் பழங்குடியினருக்கான தேசிய ஆணையம் / NATIONAL COMMISSION FOR SCHEDULED TRIBES

• NATIONAL COMMISSION FOR SCHEDULED TRIBES: பட்டியல் பழங்குடியினருக்கான தேசிய ஆணையம் (NCST) அரசியலமைப்பு (89வது திருத்தம்) சட்டம், 2003 மூலம் அரசியலமைப்பில் சட்டப்பிரிவு 338ஐத் திருத்துவதன் மூலமும், புதிய சட்டப்பிரிவு 338A ஐச் செருகுவதன் மூலமும் நிறுவப்பட்டது. 
• இரண்டு தனித்தனி கமிஷன்களால் மாற்றப்பட்டது- (i) பட்டியல் சாதிகளுக்கான தேசிய ஆணையம் (NCSC), மற்றும் (ii) பட்டியல் பழங்குடியினருக்கான தேசிய ஆணையம் (NCST) w.e.f. 19 பிப்ரவரி, 2004.

ஆணையத்தின் அதிகாரங்கள் (338A இன் பிரிவு (8) இன் கீழ்)

• விசாரணை மற்றும் விசாரணைக்காக, ஆணையத்திற்கு அதிகாரம் கொண்ட சிவில் நீதிமன்றத்தின் அதிகாரங்கள்:
• எந்தவொரு நபரையும் வரவழைத்து கட்டாயப்படுத்துதல் மற்றும் பிரமாணத்தின் பேரில் ஆய்வு செய்தல்;
• ஏதேனும் ஆவணங்களைக் கண்டறிதல் மற்றும் தயாரித்தல்;
• பிரமாணப் பத்திரங்களில் ஆதாரங்களைப் பெறுங்கள்;
• ஏதேனும் ஒரு நீதிமன்றம் அல்லது அலுவலகத்திலிருந்து ஏதேனும் பொதுப் பதிவேடு அல்லது அதன் நகலைக் கோருதல்;
• சாட்சிகள் மற்றும் ஆவணங்களை ஆய்வு செய்வதற்கான கமிஷன்களை வழங்குதல்; மற்றும்
• எந்தவொரு ஜனாதிபதியும், ஆட்சியின் மூலம் தீர்மானிக்கலாம்.

யூனியன் மற்றும் மாநிலங்களின் ஆலோசனைகள் (338A இன் பிரிவு (9) இன் கீழ்)

• யூனியன் மற்றும் ஒவ்வொரு மாநில அரசும் பட்டியலிடப்பட்ட பழங்குடியினரைப் பாதிக்கும் அனைத்து முக்கிய கொள்கை விஷயங்களிலும் கமிஷனைக் கலந்தாலோசிக்க.

கல்வி மற்றும் கலாச்சார பாதுகாப்புகள்

• 15(4) - இதர பிற்படுத்தப்பட்ட வகுப்பினரின் முன்னேற்றத்திற்கான சிறப்பு ஏற்பாடுகள் (இதில் எஸ்டிகளும் அடங்கும்)
• 29 - சிறுபான்மையினரின் நலன்களைப் பாதுகாத்தல் (இதில் STகள் அடங்கும்)
• 46 - நலிந்த பிரிவினரின் கல்வி மற்றும் பொருளாதார நலன்களை, குறிப்பாக, பட்டியலிடப்பட்ட சாதிகள் மற்றும் பழங்குடியினரின் கல்வி மற்றும் பொருளாதார நலன்களை அரசு சிறப்பு கவனத்துடன் ஊக்குவிக்கும், மேலும் சமூக அநீதி மற்றும் அனைத்து வகையான சுரண்டல்களிலிருந்தும் அவர்களைப் பாதுகாக்கும்.
• 350 - தனித்துவமான மொழி, எழுத்து அல்லது கலாச்சாரத்தைப் பாதுகாக்கும் உரிமை;
• 350 - தாய்மொழியில் போதனை.

சமூக பாதுகாப்பு

• 23 - மனிதர்கள் மற்றும் பிச்சைக்காரர்கள் மற்றும் பிற ஒத்த வகையிலான கட்டாய உழைப்பின் போக்குவரத்தை தடை செய்தல்
• 24 - குழந்தை தொழிலாளர்களை தடை செய்தல்.

பொருளாதார பாதுகாப்புகள்

• 244 - பிரிவு(1) ஐந்தாவது அட்டவணையின் விதிகள், ஆறாவது அட்டவணையின் கீழ் உள்ள அஸ்ஸாம், மேகாலயா, மிசோரம் மற்றும் திரிபுரா ஆகிய மாநிலங்களைத் தவிர வேறு எந்த மாநிலத்திலும் உள்ள அட்டவணைப்படுத்தப்பட்ட பகுதிகள் மற்றும் பழங்குடியினரின் நிர்வாகம் மற்றும் கட்டுப்பாட்டுக்கு பொருந்தும். 
• 275 - அரசியலமைப்பின் ஐந்தாவது மற்றும் ஆறாவது அட்டவணையின் கீழ் குறிப்பிடப்பட்ட மாநிலங்களுக்கு (எஸ்டிகள் & எஸ்ஏக்கள்) மானியங்கள்.

அரசியல் பாதுகாப்புகள்

• 164 (1) - பீகார், ம.பி மற்றும் ஒரிசாவில் உள்ள பழங்குடியினர் விவகார அமைச்சர்களுக்கு வழங்குகிறது
• 330 - மக்களவையில் எஸ்டிகளுக்கு இட ஒதுக்கீடு
• 332 - மாநில சட்டப் பேரவைகளில் எஸ்டிகளுக்கு இட ஒதுக்கீடு
• 334 - இடஒதுக்கீட்டிற்கான 10 ஆண்டுகள் காலம் (காலத்தை நீட்டிக்க பல முறை திருத்தப்பட்டது
• 243 - பஞ்சாயத்துகளில் இட ஒதுக்கீடு
• 371 - NE மாநிலங்கள் மற்றும் சிக்கிம் தொடர்பாக சிறப்பு ஏற்பாடுகள்

ENGLISH

• The National Commission for Scheduled Tribes (NCST) was established by amending Article 338 and inserting a new Article 338A in the Constitution through the Constitution (89th Amendment) Act, 2003. 
• By this amendment, the erstwhile National Commission for Scheduled Castes and Scheduled Tribes was replaced by two separate Commissions namely- (i) the National Commission for Scheduled Castes (NCSC), and (ii) the National Commission for Scheduled Tribes (NCST) w.e.f. 19 February, 2004.

Powers of the Commission (Under Clause (8) of Art. 338A)

• For Investigation and Inquiry, the Commission is vested with powers of a civil court having authority to:
• Summon and enforce attendance of any person and examine on oath
• Discovery & production of any documents
• Receive evidence on affidavits
• Requisition any public record or copy thereof from any court or office
• Issue Commissions for examination of witnesses and documents; and
• Any matter which President, by rule, may determine.

Consultations by Union and States (Under Clause (9) of Art. 338A)

• Union and every State Govt. to consult the Commission on all major Policy matters affecting Scheduled Tribes.

Educational & Cultural Safeguards

• Art. 15(4) - Special provisions for advancement of other backward classes (which includes STs);
• Art. 29 - Protection of Interests of Minorities (which includes STs);
• Art. 46 - The State shall promote, with special care, the educational and economic interests of the weaker sections of the people, and in particular, of the Scheduled Castes, and the Scheduled Tribes, and shall protect them from social injustice and all forms of exploitation,
• Art. 350 - Right to conserve distinct Language, Script or Culture;
• Art. 350 - Instruction in Mother Tongue.

Social Safeguard

• Art. 23 - Prohibition of traffic in human beings and beggar and other similar form of forced labour
• Art. 24 - Forbidding Child Labour.

Economic Safeguards

• Art.244 - Clause(1) Provisions of Fifth Schedule shall apply to the administration & control of the Scheduled Areas and Scheduled Tribes in any State other than the states of Assam, Meghalaya, Mizoram and Tripura which are covered under Sixth Schedule, under Clause (2) of this Article.
• Art. 275 - Grants in-Aid to specified States (STs &SAs) covered under Fifth and Sixth Schedules of the Constitution.

Political Safeguards

• Art.164 (1) - Provides for Tribal Affairs Ministers in Bihar, MP and Orissa
• Art. 330 - Reservation of seats for STs in Lok Sabha
• Art. 332 - Reservation of seats for STs in State Legislatures
• Art. 334 - 10 years period for reservation (Amended several times to extend the period
