- The Waqf (Amendment) Bill was passed in Parliament amid strong opposition and became law last April. While cases were filed in the Supreme Court seeking a ban on this law, the court has given its verdict today. Some of the points mentioned in the verdict have been welcomed.
- In particular, can a non-Muslim be appointed as the CEO of the State Waqf Board? The court has also answered the question.
- The court refused to stay the entire law. But it has banned certain aspects. In particular, the condition that a person should have followed Islamic practice for at least five years to establish a waqf has been banned. This ban will continue until the state governments make rules to verify this condition.
- The clauses that do not recognize the land as waqf land until a decision is taken regarding the land allegedly occupied by the government have also been banned. The Supreme Court has said that allowing the District Collector to decide cases related to occupation is against the separation of powers.
- The disputed waqf land will not be affected until a tribunal or court decides on the ownership of the waqf land. At the same time, the court has said in its order that no third-party rights should be created in those lands until the dispute is resolved.
- It has clarified that the number of non-Muslim members in the Central Waqf Council should not exceed four and the number of non-Muslim members in the State Waqf Boards should not exceed three.
- That is, in the Central Waqf Council, not more than 4 non-Muslim members out of 22 members should be members. Similarly, the court has ordered that in the Board constituted under Section 14 of the Amended Waqf Act, not more than 3 non-Muslim members out of 11 members should be members.
- The court did not interfere with the provision that a non-Muslim can be appointed as the Chief Executive Officer of the State Waqf Board. However, the court has emphasized that, wherever possible, a Muslim person should be appointed.
- A bench comprising Justice P.R. Kawai and Justice A.G. Masih have mentioned the above points in their judgments.
