திருநங்கைகள் (உரிமைகள் பாதுகாப்பு) விதிகள், 2020 / TRANSGENDER PERSONS (PROTECTION OF RIGHTS) RULES, 2020: சமூக நீதி மற்றும் அதிகாரமளித்தல் அமைச்சகம், 25 செப்டம்பர் 2020 அன்று, திருநங்கைகள் (உரிமைகள் பாதுகாப்பு) விதிகள், 2020 என அறிவிக்கப்பட்டது. திருநங்கைகள் (உரிமைகள் பாதுகாப்பு) சட்டம் 2019 இன் பிரிவு 22 இன் கீழ் வழங்கப்பட்ட அதிகாரங்களைப் பயன்படுத்தி விதிகள் வெளியிடப்பட்டன.
விதிகள்
அடையாளச் சான்றிதழ்: அடையாளச் சான்றிதழைப் பெறுவதற்கான விண்ணப்பத்தை, திருநங்கைகள் வசிக்கும் மாவட்ட ஆட்சியரிடம் தபால் மூலமாகவோ அல்லது ஆன்லைனிலோ சமர்ப்பிக்க வேண்டும் என்று விதி 3 கூறுகிறது.
நல நடவடிக்கைகள்: திருநங்கைகளின் உரிமைகளைப் பாதுகாப்பதற்காக அரசாங்கத்தால் மேற்கொள்ளப்படும் திட்டங்கள் மற்றும் நலன்புரி நடவடிக்கைகளைப் பெறுவதற்கு வசதியாக ஒரு நல வாரியம் அமைக்கப்பட வேண்டும் என்று விதி 10 வழங்குகிறது.
பாகுபாடு காட்டாத விதிகள்: பொது வாழ்வில் திருநங்கைகள் பாகுபாடு காட்டப்படுவதை உறுதி செய்வதற்கான வழிமுறைகளை விதிகள் வழங்கியுள்ளன. எடுத்துக்காட்டாக, திருநங்கைகளுக்கு எதிரான குற்றங்கள் தொடர்பான வழக்குகளைக் கண்காணிக்க மாவட்ட மாஜிஸ்திரேட் மற்றும் காவல்துறை இயக்குநர் ஜெனரல் ஆகியோரின் பொறுப்பின் கீழ் திருநங்கைகள் பாதுகாப்புப் பிரிவை அமைக்க வேண்டும் என்று விதிகள் கோருகின்றன.
வேலை வாய்ப்பில் சம வாய்ப்பு: அனைத்து நிறுவனங்களும் உள்கட்டமைப்புச் சரிசெய்தல், ஆட்சேர்ப்பு, வேலைவாய்ப்புப் பலன்கள் மற்றும் திருநங்கைகளுக்கான பதவி உயர்வு ஆகியவற்றை இணைத்து பாதுகாப்பான சூழலையும் சம வாய்ப்புகளையும் வழங்குவதை உறுதிசெய்ய வேண்டும் என்று விதி 11 வழங்குகிறது. அனைத்து நிறுவனங்களும் தங்கள் சம வாய்ப்புக் கொள்கையை வெளியிடுவது கட்டாயமாகும்.
குறை நிவர்த்தி: ஒரு வருடத்திற்குள் குறை தீர்க்கும் பொறிமுறையை நிறுவவும், புகார்களைக் கண்காணிப்பதற்கான கண்காணிப்பு அமைப்பை ஏற்படுத்தவும் விதிகள் அரசாங்கத்தை வழிநடத்துகின்றன. மேலும், புகார் அலுவலரை நியமிக்க வேண்டும் என்று விதி 13 கூறுகிறது. புகார்களைப் பெற்ற 15 நாட்களுக்குள் அவர்கள் புகார்களை விசாரித்து, மனு தாக்கல் செய்த 30 நாட்களுக்குள் குறைகளுக்கு தீர்வு காண வேண்டும்.
தேசிய கவுன்சில்: தேசிய சமூக பாதுகாப்பு நிறுவனம், திருநங்கைகளுக்கான தேசிய கவுன்சிலின் செயல்பாடுகளை எளிதாக்குவதற்கு செயலக உதவியை வழங்க வேண்டும் என்று விதிகள் கூறுகின்றன.

திருநங்கைகள் (உரிமைகள் பாதுகாப்பு) விதிகள், 2020 / TRANSGENDER PERSONS (PROTECTION OF RIGHTS) RULES, 2020: The Ministry of Social Justice and Empowerment, on 25th September 2020, notified the Transgender Persons (Protection of Rights) Rules, 2020.
The Rules were issued in exercise of its powers conferred under Section 22 of the Transgender Persons (Protection of Rights) Act 2019 (‘2019 Act’).
Rules
Certificate of Identity: Rule 3 prescribes that the application for obtaining a Certificate of Identity must be submitted, either by post or online, to the District Magistrate within whose jurisdiction the transgender person resides.
Welfare measures: Rule 10 provides that a Welfare Board be constituted to facilitate the access to schemes and welfare measures taken by the Government for the protection of transgender persons’ rights.
Provisions of Non-Discrimination: The Rules have provided mechanisms for ensuring non-discrimination of transgender persons in public life. For example, the Rules require setting up a Transgender Protection Cell under the charge of the District Magistrate and the Director-General of Police to monitor cases of offences against transgender persons.
Equal Opportunity in Employment: Rule 11 provides that all establishments shall ensure that they provide a safe environment and equal opportunities by incorporating infrastructure adjustments, recruitment, employment benefits and promotion for transgender persons. It is mandatory for all establishments to publish their Equal Opportunity policy.
Grievance Redressal: Rules direct the Government to establish a grievance redressal mechanism within one year and put into place a monitoring system for tracking the complaints. Further, Rule 13 provides that the complaints officer should be appointed. They should inquire into complaints within 15 days of receiving the complaint and the resolution of grievances should take place within 30 days from the filing.
National Council: The Rules state that the National Institute of Social Defence shall give secretarial assistance to facilitate the discharge of functions of the National Council for Transgender Persons.
