கையால் துப்புரவு செய்பவர்களாக வேலை செய்ய தடை மற்றும் அவர்களின் மறுவாழ்வு சட்டம், 2013 / PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITION ACT 2013 (MS Act, 2013): உலர் கழிப்பறைகளை அகற்றுதல் மற்றும் கையால் துப்புரவு செய்தல் மற்றும் மாற்றுத் தொழிலில் உள்ள கையால் துப்புரவு செய்பவர்களுக்கு மறுவாழ்வு வழங்குதல் ஆகியவை அரசாங்கத்திற்கு அதிக முன்னுரிமை அளிக்கும் பகுதியாகும்.
இந்த நோக்கத்திற்காக, பின்வரும் சட்டமன்ற மற்றும் வேலைத்திட்ட தலையீடுகளை உள்ளடக்கிய ஒரு பல்நோக்கு மூலோபாயம் பின்பற்றப்பட்டது:
"கையால் துப்புரவு பணியாளர்களை பணியமர்த்துதல் மற்றும் உலர் கழிப்பறைகள் கட்டுதல் (தடை) சட்டம், 1993 (1993 சட்டம்);"
நகர்ப்புறங்களில் உலர் கழிப்பறைகளை சுகாதார கழிப்பறைகளாக மாற்றுவதற்கான ஒருங்கிணைந்த குறைந்த விலை சுகாதாரம் (ILCS) திட்டம்; மற்றும்
தோட்டிகளின் விடுதலை மற்றும் மறுவாழ்வுக்கான தேசியத் திட்டத்தை (என்எஸ்எல்ஆர்எஸ்) தொடங்குதல்.
கையால் சுத்தம் செய்பவர்களின் மறுவாழ்வுக்கான சுயவேலைவாய்ப்புத் திட்டம்.
அரசாங்கம் மேற்கூறிய நடவடிக்கைகள் இருந்தபோதிலும், கையால் துப்புரவாக்குதல் தொடர்ந்தது, இது 2011 ஆம் ஆண்டு வெளியான மக்கள்தொகை கணக்கெடுப்பின் மூலம் நாட்டில் 26 லட்சத்திற்கும் அதிகமான சுகாதாரமற்ற கழிப்பறைகள் இருப்பதைக் குறிக்கிறது.
எனவே, அனைத்து வகையான சுகாதாரமற்ற கழிப்பறைகள் மற்றும் கையால் துப்புரவு செய்வதற்கு சந்தர்ப்பம் அளிக்கும் சூழ்நிலைகளை உள்ளடக்கும் வகையில் மற்றொரு சட்டத்தை இயற்ற அரசு முடிவு செய்தது.
'கையால் துப்புரவு செய்பவர்களாக பணியமர்த்தப்படுவதைத் தடைசெய்தல் மற்றும் அவர்களின் மறுவாழ்வுச் சட்டம், 2013' (MS சட்டம், 2013) செப்டம்பர் 2013 இல் பாராளுமன்றத்தால் நிறைவேற்றப்பட்டு டிசம்பர் 6, 2013 முதல் நடைமுறைக்கு வந்துள்ளது.
நோக்கங்கள்
PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITION ACT 2013 (MS Act, 2013): சுகாதாரமற்ற கழிவறைகளை கண்டறிந்து அகற்ற வேண்டும்.
தடை:- i) கையால் துப்புரவாளர்களாக பணியமர்த்துதல் மற்றும் ii) கழிவுநீர் மற்றும் கழிவுநீர் தொட்டிகளை அபாயகரமான கையால் சுத்தம் செய்தல்
கையால் துப்புரவு செய்பவர்களைக் கண்டறிந்து மறுவாழ்வு அளிக்கவும்
ENGLISH
PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITION ACT 2013 (MS Act, 2013): Eradication of dry latrines and manual scavenging and rehabilitation of manual scavengers in alternative occupation has been an area of high priority for the Government. Towards this end, a multi-pronged strategy was followed, consisting of the following legislative as well as programmatic interventions:
Enactment of “Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993(1993 Act);”
Integrated Low Cost Sanitation (ILCS) Scheme for conversion of dry latrines into sanitary latrines in urban areas; and
Launching of National Scheme for Liberation and Rehabilitation of Scavengers (NSLRS).
Self Employment Scheme for Rehabilitation of Manual Scavengers.
In spite of the above measures taken by the Government, manual scavenging continued to exist which became evident with the release of 2011 the Census data indicating existence of more than 26 lakh insanitary latrines in the country.
Therefore, Government decided to enact another law to cover all types of insanitary latrines and situations which give occasion for manual scavenging. The ‘Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013’ (MS Act, 2013) was passed by the Parliament in September, 2013 and has come into force from 6th December, 2013.
Objectives
PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITION ACT 2013 (MS Act, 2013): Identify and eliminate the insanitary latrines.
Prohibit i) Employment as Manual Scavengers and ii) Hazardous manual cleaning of sewer and septic tanks
