The collegium for appointing Supreme Court and High Court judges consists of 6 members instead of 5 judges

  • Supreme Court and High Court judges are nominated and appointed by a panel of 5 judges headed by the Chief Justice of the Supreme Court known as the 'Collegium'. This practice has been in place since 1998.
  • In this case, instead of the practice of 5 judges in the collegium panel, the procedure of 6 judges will be implemented for the first time. At present Chief Justice of the Supreme Court U.U. Lalit is the Chairman of the Collegium Committee.
  • While he is going to retire in the first week of next month, TY Chandrachud will be sworn in as the next Chief Justice of the Supreme Court on November 9. He will retire on November 10, 2024.
  • The 5-member collegium headed by Justice DY Chandrachud also includes four Supreme Court Justices SK Kaul, KM Joseph, SA Naseer and MR Shah. All four of them will retire before the retirement of TY Chandrachud. None of them can be the next new Chief Justice of the Supreme Court.
  • Therefore, as per the Appointment of Judges Act, only one of the judges in the collegium can become the next Chief Justice.
  • Accordingly, Supreme Court Justice Sanjiv Khanna is eligible to become the Chief Justice of the Supreme Court after Justice Chandrachut. Therefore, he himself has been included as the 6th judge of the panel.
  • He will become the next Chief Justice of the Supreme Court only after November 10, 2024. During his tenure as Chief Justice, Justice PR Kawai will be included in the collegium panel in terms of seniority.
  • He will be the next Chief Justice. It is to be noted that during that period again the collegium panel will consist of 5 judges as per the existing practice.
