Demolition of house by accused illegal - Supreme Court verdict
  • The process of bulldozing the houses of those accused in cases of violence, riots and crimes has started in New Delhi. Later, in many states including UP, houses were demolished by bulldozers. The Supreme Court hearing the case against this had imposed an interim stay on the bulldozer operation.
  • In this case, the Supreme Court had said that the judgment will be given today (November 13) after all the investigations are completed. In this case, today (Nov. 13), the Supreme Court Bench comprising Justices PR Kavai and KV Viswanathan gave a verdict.
  • It is illegal to bulldoze the houses of the accused. The government should not take away some of their rights. Government officials cannot decide who is guilty. Action should be taken against government officials who violate the law.
  • State authorities cannot arbitrarily violate the norms laid down by the Supreme Court. In case of abuse of power, action cannot be taken against the authorities. How can authorities allow entire families to demolish shelters when only one person is accused? No one can be held guilty without a fair trial.
  • Before any action against the accused, a detailed investigation should be conducted. Such arbitrary action by the government will destroy the basis of governance. Demolition of his house by the government because of the accused is a violation of the separation of powers. The right to housing is one of the fundamental rights conferred by the Constitution.
  • The act of demolishing houses in the middle of the night and leaving children and women on the streets is not happy. The government cannot demolish a house on the basis of a complaint by convicting a person. Thus the judges gave their verdict.
