Supreme Court abrogates Article 370 granting special status to Jammu and Kashmir
- In August 2019, the central government announced the abrogation of Article 370 of the Constitution, which granted special rights to Jammu and Kashmir. Also, the central BJP government announced the bifurcation of the state of Jammu and Kashmir into Jammu and Kashmir and Ladakh.
- The Supreme Court today delivered its verdict on the petitions filed against the abrogation of Article 370 in August 2019. Various petitions were filed in this case with a total of 2 demands. Secondly.. It is wrong to divide a state without the consent of the assembly and make it a union territory.
- Various petitions were filed focusing on these two. A five-judge constitution bench of the Supreme Court began hearing petitions challenging the abrogation of Article 370 from Jammu and Kashmir from August 2, 2023. The court heard the case for 16 days and adjourned the verdict on September 5.
- Today, a 5-judge bench delivered its judgment in this case. Out of which, a total of 3 judgments are given in this case. Chief Chandrachud delivering his judgment, Justices J Kawai, Surya Kant delivering the judgment together. Justice Sanjay Kishan Kaul and Justice Sanjeev Khanna delivered the judgment separately. But both of them have announced that they agree with the judgment of the other 3 judges.
- The abrogation of Article 370, which gave special status to Jammu and Kashmir, will be legal.
- We are of the view that Article 370 is a temporary provision. Article 370 was an interim arrangement due to war conditions in the state. The state of Jammu and Kashmir has no separate sovereignty from other states.
- Jammu and Kashmir is an integral part of India. Each state in India has a set of rules and jurisdictions. There are jurisdictional limits to the amount they can use. But Jammu and Kashmir has no separate "sovereignty".
- Decisions taken by the Union Government cannot be questioned when the President's rule is there. Jammu and Kashmir did not require the approval of the state government to abrogate Article 370 which stripped the state government of their powers without consulting them.
- The bifurcation of Jammu and Kashmir and the making of Ladakh as a Union Territory has led to a swift return to statehood for Jammu and Kashmir and elections to be held there by September 2024. Ladakh was made a Union Territory.
- The 73rd National Senior Basketball Championship was held at the Guru Nanak Dev Indoor Stadium in Ludhiana, Punjab. The Tamil Nadu team won gold in the men's category.
- The Tamil Nadu team defeated the Railway men's team by 72-67 in the final. In the women's category, the Railway team beat Kerala to win the gold. The gold winning team was awarded a prize of Rs.5,00,000. In the women's category, the Tamil Nadu team finished third and won the bronze.
- Tamil Nadu women's team won against Karnataka team. The Tamil Nadu women's team won the bronze medal with a score of 65-54. Tamil Nadu's Balathaneswarar and Railway Women's player Poonam were recognized as the Most Valuable Players. So they were given a car as a gift.
- The Ministry of Road Transport and Highways has issued a notification on December 8, 2023 making it mandatory to install air conditioning in the driver's compartment of motor vehicles of N2 and N3 types manufactured from October 1, 2025.
- Performance testing of air-conditioned driver's compartment as per IS 14618: 2022, as amended from time to time. As per this notification, any vehicle of type N2, N3 manufactured in drive-away chassis form on or after 1st October 2025 shall provide an air conditioning type approved equipment package as per IS 14618:2022.
- The Union Ministry of Environment released the draft notification on July 10, 2023 after seeking feedback from stakeholders.
