இந்திய குற்றவியல் நடைமுறை (அடையாள) மசோதா / INDIAN CRIMINAL PROCEDURE (IDENTIFICATION) BILL

  • பிரிட்டிஷ் ஆட்சியின்போது கடந்த 1920-ம் ஆண்டு குற்றவியல் நடைமுறை மசோதா கொண்டு வரப்பட்டது. 
  • கடந்த 102 ஆண்டுகளாக அமலில் இருந்த இந்த சட்டத்தில் திருத்தங்கள் செய்து இந்திய குற்றவியல் நடைமுறை (அடையாள) மசோதாவை தற்போதைய பாஜக அரசு வரையறுத்தது. கடந்த மார்ச் இறுதியில் நாடாளுமன்றத்தில் மசோதா தாக்கல் செய்தது.
  • எதிர்க்கட்சிகளின் கடும் ஆட்சேபத்தை மீறி மக்களவையில் கடந்த 4-ம் தேதியும், மாநிலங்களவையில் கடந்த 6-ம் தேதியும் மசோதா நிறைவேற்றப்பட்டது. 
  • இதன்படி எந்தவொரு வழக்கில் கைதானாலும் அவரிடம் இருந்து கை, கால் விரல் ரேகைகள் உள்ளிட்ட உயிரியல் மாதிரிகளை சேகரிக்க முடியும். அதாவது ரத்தம், தலைமுடி, சளி, எச்சில் உள்ளிட்ட மாதிரிகளை சேகரிக்கலாம்.
  • மேலும் குற்றவாளியின் புகைப்படம், கருவிழி, கையெழுத்து, பழக்க வழக்கங்கள் உள்ளிட்டவையும் பதிவு செய்யப்படும். இதற்கான முழு அதிகாரம் காவல்துறைக்கு வழங்கப்படுகிறது. சேகரிக்கப்பட்ட விவரங்கள் தேசிய குற்ற ஆவண காப்பகத்தில் 75 ஆண்டுகள் வரை மின்னணு வடிவத்தில் பாதுகாக்கப்படும்.
  • பெண்கள், குழந்தைகளுக்கு எதிரான குற்றங்களை செய்தவர்கள், 7 ஆண்டுகள் சிறை தண்டனை பெற்றவர்களின் உடல் பாகங்கள், உயிரியல் அடையாளங்களை வலுக்கட்டாயமாக பெற புதிய சட்டம் வகை செய்கிறது. 
  • தடுப்பு காவல் சட்டத்தின் கீழ் கைது செய்யப்பட்டவர்களிடம் இருந்தும் உயிரியல் மாதிரிகளை சேகரிக்க முடியும். மேலும் நீதிபதியின் உத்தரவின்பேரில் கைது செய்யப்படாத நபரிடம் இருந்தும் உயிரியல் மாதிரிகளை சேகரிக்கலாம்.
  • நாடாளுமன்றத்தின் இரு அவைகளிலும் நிறைவேற்றப்பட்ட இந்திய குற்றவியல் நடைமுறை (அடையாள) சட்டம் குடியரசுத் தலைவரின் ஒப்புதலுக்கு அனுப்பப்பட்டது. 
  • இந்த மசோதாவுக்கு குடியரசுத் தலைவர் ராம்நாத் கோவிந்த் முன்தினம் ஒப்புதல் அளித்தார். இதைத் தொடர்ந்து புதிய சட்டம் அதிகாரப்பூர்வமாக அரசிதழில் வெளியிடப்பட்டது.

  • The Criminal Procedure Code was introduced in 1920 during the British rule. The present BJP government has amended the law which has been in force for the last 102 years and defined the Indian Criminal Procedure (Identity) Bill. The bill was tabled in Parliament at the end of last March.
  • The bill was passed in the Lok Sabha on April 4 and in the state assembly on June 6, despite strong opposition from the opposition.
  • Thus in any case the arrestee can collect biological samples from him including hand and toe fingerprints. I.e. collect samples including blood, hair, mucus, saliva.
  • Also recorded will be the offender's photo, iris, signature, and customs. The full authority for this is vested in the police. The collected data will be stored electronically in the National Criminal Records Bureau for up to 75 years.
  • The new law makes it mandatory to obtain the body parts and biological identities of those convicted of crimes against women and children and those sentenced to 7 years in prison.
  • Biological samples can also be collected from detainees under the Prevention of Detention Act. Biological samples may also be collected from a person who has not been arrested on a judge's order.
  • The Indian Criminal Procedure (Identification) Act, passed by both Houses of Parliament, was sent to the President for approval.
  • The bill was earlier approved by President Ramnath Govind. Following this, the new law was officially published in the Gazette.
